Welcome to the Valentina Rose website conditions for use. These conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the conditions set out below. If you do not agree to be bound by these conditions you may not use or access this Website.
Before you place an order, if you have any questions relating to these conditions please contact us by e-mail.
Access You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.
Orders We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.
The technical steps required to create the contract between you and us are as follows:
You place the order for your products on the web-site by pressing the confirm order button at the end of the check-out process. You will be guided through the process of placing an order by a series of simple instructions on the web-site. We will send to you an order acknowledgement email detailing the products you have ordered. As your product is shipped from our warehouse we will send you a dispatch confirmation email. Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the Products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with our conditions set out below. Non acceptance of an order may take place in the following circumstances:
1 .The product you ordered being unavailable from stock.
2. Our inability to obtain authorization for your payment.
3. The identification of a pricing or product description error.
4. You not meeting the eligibility to order criteria set out in the main Conditions of Use. The contract will be concluded in English.

REFUSAL OF TRANSACTION
We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content onthis Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun. To be eligible to purchase Products on this Website and lawfully enter into and form contracts on this Website under English law you must:
- Register by providing your real name, phone number, postal/delivery address, e-mail address, payment details and other requested information.
2. Possess a valid credit or debit card issued by a bank acceptable to us
By making an offer to buy a Product, you specifically authorize us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions.
PAYMENT
All prices are stated in £sterling (with the option to change currency according to each individuals preference) and are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the Products ordered plus delivery charges. Payment can be made by any of the methods specified in the payment section of this Website and payment will be debited and cleared from your account prior to dispatch of orders.
You confirm that the credit or debit card that is being used is yours.
All credit/debit cardholders are subject to validation checks and authorization by the card issuer.
If the issuer of your payment card refuses to or does not, for any reason, authorize payment to us, we will not be liable for any delay or non-delivery.
ORDER AMENDMENTS
Unfortunately we are unable to amend your order once it has been submitted. Please note that this includes changing the size or colour of an item, removing an item, changing the delivery address or any payment methods.

REFUNDS
Items must be returned in a fully resalable condition, which means being unused with swing tags attached. We reserve the right to refuse a refund on items deemed not to be resalable. This does not affect your statutory rights in connection with faulty items.
You may return your purchase (or part of it) for a refund, within 14 days of receiving it, by posting the item(s) back to us at the address listed below. Please note that we are unable to refund the original delivery charge and your returns charge of £2.50 will be taken from your refund amount.
Any returns from the ROI customers are reliable for any duty charges, the delivery charge of the items.
SALES AND DISCOUNTS
Please note that only one discount code can be used per transaction and can only be applied to full price items, unless otherwise stated. Discount codes can only be used for online transactions on www.valentinarose.co.uk and not in any stores or concessions.
PRIVACY POLICY
We will treat all your Personal Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation from time to time in place.
When you shop on this Website, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, billing address, delivery address, telephone number, product selections, credit card or other payment information and a password. We may also collect, and our third party providers of advertisements and content may collect, information about where you are on the internet (eg the URL you came from, IP address, domain types like .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, the advertisements you clicked on, and any search terms that you entered on our website ("User Information"). We may collect this information even if you do not register with us.
You should be aware that this site is being monitored and may capture information about your visit that will help us improve the quality of our service.
We confirm that any Personal Information which you provide to us (or which is available on public registers) and any User Information from which we can identify you, is held in accordance with the registration we have with the Data Commissioner's Office. When you create a shopping account while ordering online you will be given the option to receive information from Valentina Rose by post, e-mail or telephone, about products, promotions or special offers which we feel may be of interest to you. Your Personal Information may be disclosed to other reputable third parties who will help process your order. Valentina Rose requires all such third parties to treat your personal information as fully confidential and to fully comply with all applicable UK Data Protection and consumer legislation from time to time in place.
You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your Personal Information and /or User Information we are entitled do so.

EXCHANGE RATES
Please note we use our own fixed exchange rates.
CUSTOMS AND DUTY CHARGES
Depending on the value of your order and your specific country, you may be charged customs or import fees once your parcel arrives into your country. As stated in our ‘Terms and Conditions’, these fees must be paid by the customer and won’t be covered by Valentina Rose. These charges are not applied by Valentina Rose therefore can’t be refunded. The charges are set by your country and vary between orders, we’re unable to predict what the charges may be. For further information, please contact your local customs office before placing your order. You will be responsible for assuring that any products you order comply with state and federal government import regulations.
We have outlined below further information why these costs occurred and what this means for you.
On 24th December 2020, the UK and the EU reached an agreement on how to trade (the Trade and Cooperation Agreement). It entered into force on 1st January 2021. As a result of the agreement, the UK is no longer part of the EU’s single market and customs union and new rules apply.
From 1st January 2021, the UK has extended the rules which applied to non-EU postal items before. Similarly, the EU now treats postal items from the UK as it did non-EU items before. This means there may be changes to how you receive items from abroad.
As soon as you buy a product from a non-EU country, then effectively you become an importer and become liable to Customs and Excise Duty as well as Value Added Tax (VAT) payments. The goods are normally held by the Customs Authority at entry, pending the payment of duty and tax.
The recipient may then have to pay customs or VAT charges and a handling fee in the receiving country before they can claim the parcel. These charges will depend on the recipients’ country, the value of the item and whether it is a gift or commercial goods.
Customs Duty is not due for goods, provided directly to the buyer when their value does not exceed 150 euros.
This exception does not apply to perfumes and toilet waters, tobacco or tobacco products and alcoholic products which are subject to special limits on the quantity provided.
VAT is not due when the total value of all goods in a consignment (value not inclusive of customs duties or transport costs) is less than a threshold. The threshold may vary from 10 euros to 22 euros, depending on the EU country. Certain countries however, exclude mail orders from the exemption. This exception does not apply to tobacco or tobacco products, to perfumes or toilet waters and alcoholic products.
